On Tuesday 26 July the PSA sought an urgent relisting in the Industrial Relations Commission of NSW. The matter was heard before Commissioner Newall on Friday 5 August.

The relisting request was due to the Department’s refusal, despite repeated requests from the PSA, to separate the tasks of a General Scale Clerk from a Clerk 1-2 in the Administration and Stores restructure.

Therefore the PSA was seeking that the Commission order the Department to separate the tasks between the two grades and review the grades accordingly. The PSA also requested the Department clearly differentiate between tasks that were listed as being on a continuum over a number of grading levels. The reason for this request is that the PSA is concerned staff in lower graded positions will be requested to complete the tasks of higher graded roles.

Whilst Commissioner Newall empathised with the concerns of the PSA he articulated the request we had made was beyond the jurisdiction of the Commission to order the Department to comply.

As part of his recommendations though Commissioner Newall strongly recommended the Department review their new role descriptions a year after the restructure. This recommendation is in line with the advice of Mercer CED.

The PSA and delegates are currently reviewing the information received from each centre. We are particularly interested in roles that have been downgraded but will perform the same duties they were doing at the higher grade.
