At 2pm today the PSA was ordered to attend a compulsory hearing of the Industrial Relations Commission of NSW.

The orders issued by the Commission are:

  1. “The Public Service Association and Professional Officers Association Amalgamated Union of New South Wales (“the PSA”), its officers, employees and members who are employed under s21 of the Government Sector Employment Act 2013 in New South Wales are hereby ordered to immediately cease and refrain from taking any form of industrial action including any strike, stop work meeting, ban, relieving ban, limitation or restriction on the performance of work, and must not recommence, engage in or threaten to engage in industrial action while these Orders are in force.
  2. The Association and its officers, employees and agents must not induce, advise, authorise, encourage, direct, aid or abet members of the Association to organise or take further industrial action while these Orders are in force.
  3. These orders shall come into effect immediately and shall remain in force until 5.00pm on 12 May 2018.”

The PSA understands the impracticalities of members complying with the above Order and in the absence of any response to the legitimate issues raised by members in respect to the proposed job cuts.

Accordingly, the PSA has used its best endeavours to advise delegates of all the relevant sub-branches to ensure a safe return to work by the commencement of the first A-Watch on 14 April.

In the course of the proceedings PSA industrial officers have urged the Department to release the Macksam Report to allow for transparent negotiations to take place.  The Association has also sought the assistance of the Industrial Relations Commission to conduct site inspections at all facilities affected by job cuts and that risk assessments be conducted in respect to any changes to existing staffing levels.
