Goulburn Correctional Centre: Industrial action

As a result of a motion passed at the POVB Sub-branch at Goulburn CC on Friday, 26 March 2021, industrial action was taken by staff by withdrawing their labour. CSNSW lodged a section 130 dispute notification (IRC Matter No. 2021/00085056) with the NSW Industrial Relations Commission (IRC).

The matter was conciliated by Chief Commissioner Constant at 11.30am on Friday. After arguments from both parties, no resolution could be reached and a certificate of failed conciliation was issued.

The matter was set for arbitration at 2:30pm Friday. Submissions were made by CSNSW and PSA.  The parties were again unable to reach agreement in regards to the dispute.  Subsequently Chief Commissioner Constant issued Orders against the PSA with staff ordered to return to work with immediate effect.

On Saturday, 27 March 2021, Commissioner Severin has contacted the PSA by letter and has indicated that disciplinary action will commence against any staff members who are in defiance of the Industrial Relations Commission’s order.

The PSA’s ability to appeal a finding or penalty imposed under these circumstances will be complicated because the member will be seen as defying an order of the Commission hearing the appeal.

CSNSW has indicated that it is willing to negotiate on this matter but cannot enter negotiations until the orders of the IRC have been complied with.
