If you worked in another Australian parliament, chances are you would have stronger workplace protections than you do in NSW.
Parliamentary staff in other jurisdictions have Enterprise Agreements, Awards or other industrial instruments that provide staff with clearer rights and protections. In NSW, parliamentary staff are employed under a Determination and are prohibited from having an industrial instrument.
Furthermore, other jurisdictions have stronger provisions around job security, unfair dismissal rights, severance pay and independent employment arrangements. Meanwhile, NSW staff remain employed under a model where individual MPs retain significant control over employment decisions.
This is exactly why the Broderick Review identified employment insecurity as a key barrier to speaking up about bullying, harassment and misconduct. Four years later, the most significant recommendation for reform of the Members of Parliament Staff Act remains unfinished.
The PSA is calling for reform of the Members of Parliament Staff Act so you can have access to the Industrial Relations Commission and an enforceable Award.
