Special Education Working Group: An Update from Your Delegates

Special Education Working Group: An Update from Your Delegates

As you all settle into Term 2, the PSA Special Education Working Group wants to remind members of the following top topics:

Travel Training

Members are reminded that when students undertake a travel training program, School Learning Support Officers’s (SLSO’s) are there to assist the teacher.  SLSO’s should not implement travel training programs without a teacher present. SLSO’s may assist students who are already at workplaces for work experience but not deliver or pick them up without a teacher present.

If you have a student who is to commence travel training, you should ensure that an appropriate risk assessment has been completed and a plan developed with your input.

Playground Support

SLSO’s can be rostered to assist teachers in providing playground support.  However, it is not the role of the SLSO to be supervising students without a teacher.

Deep Cleaning and Emergency Cleaning

In the event of an emergency, staff are reminded that cleaning bodily fluids such as faeces and other biohazards must be undertaken by professional cleaners.  Staff are to isolate the area and report to the Executive immediately.  This may include areas such as school swimming pools and change rooms.

School Excursions / Camps

SLSO’s who attend school excursions/camps are paid.  The steps listed below must be followed prior to attending the camp.

  1. Ensure that approval for the camp has been obtained from the Director
  2. Payment is made for time worked outside normal school hours where the SLSO is engaged in assisting the students
  3. A detailed itinerary should be developed to indicate the SLSO’s role on each excursion/camp which takes into account the health care plans, behaviour plans, risk assessments and/or learning plans of individual students.
  4. Payment for travel should be included when assisting the student with any activity or support linked to these plans eg; supporting students with sensory or behaviour needs.

Expenditure Review Committee Finally Approves Pay Rise

The CPSU NSW is thrilled to inform our Administrative Support and Related Enterprise Agreement (EA) members that the much-anticipated pay rise, which brings you inline with the Public Service has finally been approved by the Expenditure Review Committee. This is a significant achievement and a testament to the collective effort and perseverance of the members and your union.

Next steps

TAFE NSW and the CPSU NSW will meet again to finalise the EA and try to get the payment in your pockets as soon as possible.

Let’s continue to stand together in solidarity and strive for greater accomplishments in the future.

Rural Fire Service Wage Case.

Historic win for Prison Officer Vocational Branch members

Historic win for Prison Officer Vocational Branch members

Historically, Corrective Services NSW (CSNSW) employees accused of misconduct have experienced significant delays until the matter is resolved. In some cases, this process has taken years.  No employee should be subject to the stress and anxiety that such a length and drawn-out process causes.

Yesterday, Jim Minns, Keith Smith and Ben Trainor from the legal Team appeared before Justice Chin in the Industrial Relations Court.

Justice Chin made a formal recommendation that CSNSW must roll out the Managing Misconduct Procedure by 1 July 2025. This means from that date, CSNSW will no longer be allowed to leave you hanging if you are facing a misconduct allegation.

Changes include:

A proper triage process At the initial stage the matter will be reviewed to ensure it if there is a sufficient and proper basis to proceed with misconduct allegations.

No more indefinite silence If you are accused of misconduct, CSNSW must tell you what the allegation is within two to four weeks. And there are set timelines for the remainder of the process.

Access to CCTV Access to all CCTV footage of the alleged misconduct will be provided to the accused at the time of receiving allegations.

A deadline to completion Most non-complex misconduct cases must be wrapped up within 16 weeks total, from start to finish.

You must be updated every 30 days If delays come up, CSNSW has to tell you why, and keep you informed.

No general prohibition on speaking with colleagues when suspended If you are suspended, you will still be allowed to speak with your colleagues, providing you do not discuss the matter. If CSNSW believse there is a good reason that you cannot speak to specific persons, the organisation must advise you of this.

We look forward to distributing the finalised procedure as soon as possible.

And that’s not all.

We also have an in-principle agreement to amend to the Correctional Officers Award to include reference to the misconduct procedure. This includes the timeframes. This gives more surety that failure to adhere to the procedure can be enforced.

CSNSW and the Department of Communities and Justice must follow the procedure. No more dragging things out. No more mystery. Just a fair and transparent process.

This has been a long fight: 11 months in the Industrial Relations Commission and 12 years under the Government Sector Employment Act. But we never gave up, and today, we won.

If you’ve ever felt stressed, isolated or kept in the dark during a misconduct process, this win is for you.

It puts power back in your hands and holds management to proper standards.

We’ll keep pushing to make sure these changes are rolled out properly and enforced.

The pain and suffering caused by the Professional Standards and Investigations process has been difficult to stomach. Absolute credit goes to all of the members for their patience and trust put in the Prison Officer Vocational Branch State Executive in obtaining a result.

None of this could have happened without the commitment of Keith Smith, Dave McCauley, Jim Minns, Jason Charlton, Alison McRobert and Ben Trainor, who worked tirelessly to help achieve this result for the members.

In union,
Keith Smith

Historically, Corrective Service NSW (CSNSW) employees accused of misconduct have experienced significant delays until the matter is resolved, sometimes the process has taken years.  No employee should be subject to the stress and anxiety that such a lengthy and drawn-out process causes.

Yesterday, 22 May 2025, POVB representatives Jim Minns, Keith Smith and Ben Trainor from the Legal Team appeared before Justice Chin in the Industrial Relations Court. Whilst a POVB initiated dispute, it has resulted in all members across CSNSW finally have a misconduct procedure that must be followed.

Justice Chin made a formal recommendation that Corrective Services NSW (CSNSW) must roll out the Managing Misconduct Procedure by 1 July 2025. This means from that date, CSNSW will no longer be allowed to leave you hanging if you are facing a misconduct allegation.

Here’s some of what changes:

A proper triage process – At the initial stage the matter will be reviewed to ensure it if there is a sufficient and proper basis to proceed with misconduct allegations.

No more indefinite silence – If you are accused of misconduct, CSNSW must tell you what the allegation is within 2 to 4 weeks.  And there are set timelines for the remainder of the process.

No general prohibition on speaking with colleagues when suspended – If you are suspended, you will still be allowed to speak with your colleagues, providing you do not discuss the matter. If CSNSW believe there is a good reason that you cannot speak to specific persons, they must advise you of this.

We look forward to distributing the finalised Procedure as soon as possible.

CSNSW and Department of Communities and Justice (DCJ) must follow the procedure. No more dragging things out. No more mystery. Just a fair and transparent process.

This has been a long fight, (eleven months in the industrial relations commission, and twelve years under the government sector employment act) but we never gave up, and today, we won.

It puts power back in your hands and holds management to proper standards.

We’ll keep pushing to make sure these changes are rolled out properly and enforced.

The pain and suffering caused by the PSI process has been difficult to stomach, and absolute credit goes to all of the members for their patience and trust put in the POVB State Executive, Industrial Team and Legal Team in obtaining a result.

None of this could have happened without the commitment of Dave McCauley, Jim Minns, Jason Charlton, Alison McRobert and Ben Trainor who worked tirelessly to help achieve this result for PSA members.

Vote NO. Serco to ballot Case Correctional Officers on new Enterprise Agreement despite union opposition

Vote NO. Serco to ballot Case Correctional Officers on new Enterprise Agreement despite union opposition

Serco Australia has advised the CPSU NSW that it intends to ballot Case Correctional Officers for a new enterprise agreement without union support.

After months of negotiation the parties have been unable to reach agreement on a new package for staff, with the company formally rejecting the union’s offer of settlement on Wednesday afternoon.

While the company’s position is disappointing, it is not unexpected. We will be recommending Case Correctional Officers vote NO.

“Unfortunately Serco’s offer just doesn’t meet our bottom line and we can’t endorse it,” said Thane Pearce from the CPSU NSW’s bargaining team. “We have to be confident any package will see growth in real wages, and we are not confident a 3 per cent uplift in the second year does that.

“While the Australian economy remains strong, the global outlook is very uncertain.

“For that reason we need to be careful to ensure correctional staff do not go backwards in real terms.

“We will be calling members over the next several days to explain why they should vote no and send Serco back to the table.”
