Update on the Workplace Presence Policy roll-out

The Public Service Association (PSA), alongside the Combined Transport Unions, has  raised a dispute with Transport for NSW (TfNSW), about safety concerns in the introduction of the Workplace Presence Policy alongside the Operating Model Restructure. TfNSW has written to the PSA proposing additional carve-outs for non-frontline employees for recording hybrid arrangements as set out below:

  1. Employees already placed, including TSSE employees, will be required to have a recorded hybrid arrangement in place by 2 March 2026. This includes those who either having gone through the Op Model process or are unaffected by the TfNSW Op Model process.
  2. TfNSW employees whose branches have been not stood up by the end of 2025 will only need to have a recorded hybrid arrangement in place by four weeks after their branch stand up in 2026.
  3. Unplaced TfNSW employees will be exempt from the Workplace Presence Policy until they are placed.

Extending the timeframe for employees to record their hybrid arrangements provides employees with additional flexibility and more time to engage in meaningful conversations with leaders, complete and submit their forms, and obtain the necessary approvals.

Next steps from TfNSW

TfNSW will now update schedules and briefing packs to ensure clear and consistent communication on submission dates for all branches undergoing reform.

Workplace adjustments

The PSA wishes to remind TfNSW employees that Workplace Adjustments are separate from, and take precedence over, flexible work arrangements.

Workplace adjustments specifically relate to TfNSW’s legal obligations under the Disability Discrimination Act 1992 (Cth) and the Anti-Discrimination Act 1977 (NSW).

For those with a workplace adjustment in place, this will continue with no change. TfNSW has confirmed that you do not need to have a separate hybrid agreement or submit a new workplace adjustment request.

Individual hybrid agreements

Members are reminded that TfNSW cannot unreasonably decline an individual hybrid agreement. This is a key change the PSA sought out.

The PSA, alongside the Combined Transport Unions, is considering these changes to the implementation of the Workplace Presence Policy as well as other options available to secure the best possible outcome for members.
