Update: your rights regarding severance packages and offers from Serco

The PSA has received advice that if you take a voluntary redundancy from Corrective Services NSW and accept a role with Serco, you will not be required to repay any portion of your severance package.

This has been confirmed by correspondence sent to us on on13 December 2019.

As advised in our BULLETIN dated 9 September 2019, Corrective Services NSW’s position on VRs was that under Clause 24 of the Government Sector Employment Regulation 2014:

(1) A government sector employee who receives a severance or redundancy payment because of a cessation of employment is not to be employed in the public sector during the period to which the payment relates unless arrangements have been made for a refund of the proportionate amount of the payment

The PSA, as outlined within our bulletin, disputed this position and proceeded to take action before the NSW Industrial Relations Commission.

The decision reached by the NSW Government is right and fair and is what the PSA has been fighting for.
