Damning IRC findings: DPIRD, by the actions of Dr Andrew Moriarty, unlawfully victimised PSA delegate

The Industrial Relations Commission (IRC) has found that it is “highly likely” and “probable” that an “extremely agitated, extremely wound up, very angry” Dr Andrew Moriarty, former Director of the Fisheries Compliance Unit, victimised Joe Wright, PSA Delegate, because he participated in the PSA’s media and industrial campaign to improve workplace safety.

The decision has broken new ground: most significantly the IRC has found that it is unlawful to punish a union delegate for speaking to the media about an industrial campaign. This is a big win for the rights of delegates.

This win comes after the PSA successfully prevented the Department of Primary Industries and Regional Development from obtaining orders to compel Fisheries Officers to lift work bans in late 2024: another landmark decision for workers’ rights. The PSA is now preparing to arbitrate its claim for increased salaries and improved conditions under the Fisheries Officers Award, which will be in hearing in 2026.
