Industrial Bulletin NSW Police Force – Special Constables (Security)

The anticipated legislation, amending some of the condition of employment for Special Constables (Security), has passed both houses of the NSW Parliament and will come into effect after the NSW Governor assents to the Act.

Once this happens the NSW Police Force will enact the transfer of Special Constables (Security) from the status of ministerial employee to permanent officers under the Police Act 1990.

The main benefit of the legislative change is you transfer from ministerial employee status to permanent status under the Police Act 1990. As a ministerial employee you were employed at the “grace and favour” of the Minister, however, as a permanent officer you have the protection of the conditions of employment under the Police Act.

Industrial coverage will remain under the Crown Employees (NSW Police Force Special Constables (Security) Award.

The Public Service Association of NSW (PSA) and NSW Police will enter into consultation on how the legislation will affect your award and policies covering your conditions of employment. The newly elected executive of the Special Constables (Security) Vocational Group, together with officers of the PSA, will consult with representatives of NSW Police Force.

A briefing on the change was presented by representatives of NSW Police Employee Relations on Tuesday, 17 September 2013. A copy of the briefing paper produced by NSW Police is attached for your information.

Opportunities for you to apply for advertised positions within the NSW Police Force will be enhanced, should you wish to apply.

The PSA representatives will report back to you through meetings convened to discuss any proposed changes to the Award and/or policies that may affect you or your job. If necessary, a ballot of PSA members will be conducted.
