As part of the transfer process, both ONRSR and the PSA (CPSU) have provided detail with respect to the operation of the state-copied award and the ONRSR Enterprise Agreement. The decision by the NSW Government to enact the Government Sector Employment Amendment (Transfers to Non-Government Sector) Regulation 2016 has also curtailed a number of options available to affected staff. ITSR will transfer across to ONRSR on the basis that ONRSR is providing comparable employment.

This process began with meetings of staff and the provision of an initial offer, subsequent negotiations between the PSA (CPSU) and ONRSR; and a clarification of outstanding issues relating to Flextime, part-time work, leave without pay, recognition of service, guarantees of employment, higher duties and promotional positions, workers compensation liabilities and ‘authorised officer’ passes.

The PSA (CPSU) acknowledges there are outstanding issues with respect to recognition of ONRSR service for NSW Public Sector purposes and Authorised Officer Passes. However, these matters should not hold up a decision on the offer of employment from ONRSR, as they can be progressed separately.

Assuming these matters will be finalised either way, part of your union’s democratic processes is that members vote upon whether to accept the offer provided by ONRSR to move on to the ONRSR Enterprise Agreement – with enforceable undertaking with respect to salaries and allowances – or continue with the application of the copied State Award.

From the onset, the PSA (CPSU) has iterated it does not have a preference for either option. Through exhaustive discussions, the membership has identified that there are both pros and cons with respect to either approach.

The membership vote will direct the approach taken by the PSA (CPSU) with respect to the industrial instrument identified as the vehicle for transfer. A ‘No’ vote will seek for the default process of the copied state award to apply.
