As mentioned in the PSA’s previous bulletins, the PSA is pursuing two claims against the Department in respect of judicial associates:

  1. The Historical Claim: the PSA is asserting that the Crown Employees (Public Service Conditions of Employment) Reviewed Award 2009 (the Conditions Award) and the Crown Employees (Administrative and Clerical Officers – Salaries) Award (the Salaries Award) apply to associates and have applied since associates have been engaged as public servants.
  2. The Prospective Claim: the PSA is pursuing the creation of an award specifically for associates, to be known as the Crown Employees (Associates) Award (Associates Award) which will apply prospectively and will apply along with the Conditions Award and Salaries Award.

The PSA provides the following update in respect of these two claims.

The Historical Claim

The PSA and the Department have been in negotiations to resolve the historical claim since October 2023. The PSA is confident that an in-principle agreement will be reached in the coming weeks which will then be put to a vote of membership.

The Prospective Claim

Due to the Department’s failure to substantively respond to the PSA’s log of claims (which was provided on 18 October 2023, and which was based on membership feedback provided on 29 September 2023), the PSA has decided to commence further proceedings under s 10 of the Industrial Relations Act 1996 (NSW) to have IRC create the Associates Award.

The PSA has prepared a draft application which is based upon the log of claims. There is one remaining issue which the PSA wants membership’s opinion on before the PSA commences proceedings. We encourage all members to complete the survey HERE to have a say on this remaining issue.
