Legality of POVB Motion

Information has been circulated amongst POVB Legal Fund members which is incorrect.

In order to address this misinformation I am providing a link HERE to the legal advice which was provided by Maurice Blackburn Lawyers dated 2 July 2015.

In particular note on page 1 of the advice to the Trustees.

“In our view, clause G of the Constitution does not permit you to implement the motion and the trustees should not, at this time, make any payment to Mr Shaw’s solicitors or to the POVB in order for the POVB to make such a payment”.

On occasion trustees of the POVB Legal Fund are lobbied by individuals and their supporters to go outside of the rules of the POVB Legal Fund Constitution.

This is not in the interests of the broader membership or the long term viability of the fund and Trustees have no authority to do this.
