The National Disability Insurance Scheme Draft Rules

The National Disability Insurance Scheme (NDIS) will commence its trial period in the Hunter from July this year. The government has just released the rules around eligibility for inclusion in this trial and the others taking place around the country.

 The following is an Australian Government summary:

The Australian Government has released rules that will guide how the National Disability Insurance Scheme (NDIS) works for people with disability, their families, carers and service providers.

The rules support the National Disability Insurance Scheme Bill 2012, which is currently before the Australian Parliament. The Bill establishes the NDIS, including eligibility criteria and what constitutes reasonable and necessary support. It also establishes the NDIS Agency to deliver the Scheme.

The rules provide a further level of detail on how the NDIS will work, including how people with disability will be able to access the scheme, and how the Agency will determine what supports are reasonable to meet a person’s needs.

The rules now released cover these aspects of the scheme:

  • NDIS Rules for becoming a participant
  • NDIS Rules for the protection and disclosure of information
  • NDIS Rules – Support for participants
  • NDIS Rules – Children
  • NDIS Rules – Nominees
  • NDIS Rules – Rules for registered providers
  • NDIS Rules – Plan Management

The Government has previously released the NDIS Rules Consultation Paper which explained the purpose and scope of the NDIS rules. This may be a useful document for to consider as you look at the rules. To help, we have attached the consultation
