NHVR transition: Paperwork for National Heavy Vehicle Regulator

You would have seen from previous PSA communication the Heavy Vehicle Inspection Scheme and Heavy Vehicle National Law functions, including employees, will transition to the National Heavy Vehicle Regulator (NHVR) on 1 August 2022.

With the transition date coming NHVR has commenced engaging with those employees transitioning including sending employees’ paperwork to fill in for transition.

Members have contacted the PSA about the paperwork.

Information being requested

Whilst it is a lift and shift of services, including employment, there is still information that NHVR needs to get from the employee as TfNSW is not providing all of your information. Despite seeking written confirmation from TfNSW months ago about what information would transition we are still waiting.

Limited information on your Personnel Records is going to transition to NHVR, including medical records and performance and conduct matters.

Medical records

The PSA is of the understanding medical records have not transitioned to NHVR. NHVR has requested the provision of medical information that relates to your ability to perform the role. You do not need to provide medical information unless you require an adjustment to the role or equipment to perform the role, for example a standing desk or alternative duties.

Criminal record

We have asked for further clarity from NHVR on what needs to be declared when it relates to criminal offences.

Qualifications

We understand at this stage NHVR has not been provided with qualifications that TfNSW has on record.

COVID 19 Vaccinations

NHVR is requesting the provision of evidence of vaccination, including a booster. Members have raised concerns that the booster is required, when TfNSW policy does not require a booster.

Whilst your Award transitions with you, the policies of TfNSW do not transition unless they are referenced in the Award or your contract of employment. This means that on transition NHVR policy will apply.

We have been advised by NHVR it will provide transferring employees one month post transition to be compliant with its policy.

There are ongoing discussions about if members need to provide their evidence of vaccination in hard copy or if it can be sighted.

As we informed members when TfNSW introduced its policy, ultimately NHVR will manage you in accordance with its own policy. Simply put, this can lead to disciplinary action including termination of employment.  You can read our previous bulletin that informs members about the introduction of mandatory vaccinations by an employer.

It is important to note that those who are not compliant with TfNSW policy prior to transition date will not be transitioning and will be managed in accordance with TfNSW policy.

NHVR has requested a photo be provided. We have spoken with NHVR and it has advised this is required for Staff ID and Authorised Officer Card.
