Bullying within the RFS – What you can do

The Public Service Association (PSA) is deeply concerned about the increasing number of reported bullying cases among our members employed within the Rural Fire Service (RFS).

Members have described to the union incidents they have observed that highlight the pervasive and ongoing nature of the bullying culture at RFS. PSA delegates and staff have repeatedly raised concerns with the numerous incidents that occur across the state and will continue to advocate for a better, more psychologically safe environment for members.

Do the People Matter?

The People Matter Employee Survey (PMES) results is just one way in which members experiences can be evidenced.

According to the 2023 PMES results, it is evident that the RFS is grappling with effectively addressing bullying issues within its workforce. The statistics from PMES 2023 indicate the following rates of witnessed and experienced bullying incidents:

These survey findings underscore a concerning trend within RFS, indicating a toxic culture of workplace bullying directed towards our members. It is evident that the RFS has a poor track record in managing this behaviour.

It is clear from feedback that our members do not trust the RFS to adequately address member concerns relating to bullying.

What can you do?

Recognising bullying in the workplace is one of the first steps to changing the culture. Members should familiarise themselves with the legal definition of bullying outlined below.

Workplace bullying is repeated, and unreasonable behaviour directed towards a worker or a group of workers that creates a risk to health and safety.

Repeated behaviour refers to the persistent nature of the behaviour and can involve a range of behaviours over time.

Unreasonable behaviour means behaviour that a reasonable person, having considered the circumstances, would see as unreasonable, including behaviour that is victimising, humiliating, intimidating, or threatening.

Reporting Bullying

In the first instance, members should ensure they keep records and evidence of bullying taking place, that fit the definitions above.

We encourage all members to use the following reporting avenues if they encounter instances of bullying, ensuring their voices are heard and their concerns addressed effectively:

Members are reminded that, they can seek assistance from the PSA by calling 1300 772 679.

Safework NSW Request for Service

SafeWork NSW have a dedicated electronic request for service form. SafeWork NSW will review and if deemed necessary, investigate any request for service whilst maintaining complete confidentiality of the applicant.

Members should know that SafeWork NSW can issue improvement notices and infringements to the RFS which are legally enforceable should the RFS be found to be in breach of its Duty of Care under the Work Health & Safety Act 2011.

The PSA will be closely monitoring this issue and will be seeking to raise this at the next Joint Consultative (JCC) meeting.

Contingent Labour and Contractors

The PSA is aware of the growing issue of labour-hire staff being used in supervisory roles, up to and including Director positions. We remind members that this is contravention of the Crown Employees (Public Service Conditions of Employment) Award:

3.64    Supervisor means the immediate supervisor or manager of the area in which a staff member is employed, or any other staff member authorised by the Department Head to fulfil the role of a supervisor or manager, other than a person engaged as a consultant or contractor.
